1. Definitions
- App / Platform: The ShipX application and its websites.
- Client: The person or entity requesting shipping/transport service.
- Carrier / Driver: The person or entity registered to provide transport service.
- Cargo / Goods: The items to be transported.
2. Nature of Our Role
ShipX is a technical brokerage platform that connects clients
with drivers. The app does not perform transport itself, does
not own or operate vehicles, and does not employ drivers. It only provides a
technical platform for communication, price quoting, and transactions.
3. Carrier / Driver Responsibility
The cargo is the responsibility of the carrier from the moment of
loading until delivery.
- The driver assumes full responsibility for the safety of the cargo from pickup to delivery.
- Any damage, loss, or theft during transport is the driver's liability.
- The driver commits to delivering the cargo at the agreed time.
- Must comply with traffic and safety regulations in Saudi Arabia.
- Must carry official vehicle, license, and transport insurance documents.
4. Client Responsibility
The client is responsible for verifying the carrier meets all
requirements before handing over the cargo.
- Verify the vehicle type matches the cargo nature.
- Check driver documents (ID, driver's license, vehicle registration, insurance).
- Accurately describe the cargo (weight, size, nature) when creating the order.
- Not load prohibited or illegal materials.
- Presence of the client or representative during pickup and delivery.
- Insure the cargo with a separate insurer if desired (app does not provide cargo insurance).
5. Payment Terms & Commission
5.1 Pricing Method
- Drivers send price offers to the client.
- The client has the right to accept or reject offers.
- The final price is what is agreed upon offer acceptance.
5.2 Platform Commission
The platform charges a 10% commission on every completed order,
in exchange for technical brokerage and support services.
A 15% VAT is added per Saudi Zakat, Tax and Customs Authority
regulations.
5.3 Payment Methods
- Cash: The client pays the full amount to the driver upon
delivery, and the platform deducts its commission from the driver's balance later.
- Electronic (coming soon): Mada, Apple Pay, and STC Pay will be
added. In this case, the platform holds the amount until delivery, then
transfers it to the driver after commission deduction.
5.4 Cancellation & Refund
- Cancellation before driver acceptance: free.
- Cancellation after driver acceptance and arrival: driver may charge a compensation fee.
- Driver cancellation after acceptance: may result in rating reduction or temporary suspension.
6. Disputes Between Client and Carrier
In case of any dispute regarding cargo condition or delivery delay, direct
communication between the parties is the primary resolution. The app is
not a party to the dispute, but may offer mediation and retains order
records for reference.
7. Suspension & Banning
The app management reserves the right to suspend or delete any user account
violating these terms, especially in cases of: fraud, document forgery, abusing
another user, or transporting prohibited materials.
8. Modifications to Terms
The app may modify these terms at any time. Users will be notified of significant
changes through the app. Continued use after modification means acceptance of the
new terms.
9. Governing Law
These terms are governed by the laws of Saudi Arabia, and any dispute arising
from them falls under the jurisdiction of Saudi courts.
